Neither may you on-sell any items or information obtained from any part of this web site. All designs displayed within this website remain the intention and property of Ondesign Limited and are protected by the copyright law 1994. Prices are displayed in New Zealand dollars and include GST. Full and prompt payment must be made before any item is sent. If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect. Ondesign accepts no liability resulting from any delays in time that might occur in the production or provision of items and services provided on this website. Ondesign will send any purchased item to the purchaser(s) using a 'track and trace' system, and will inform the purchaser(s) of such details once the item(s) have been sent. Ondesign accepts no liability for any lack of performance, unavailability, or failure of the services provided by any such postage or courier company. ----------------------------------------------------------------------------------------- Web Design Terms and Conditions: All website designs remain the intention and property of Ondesign Limited and are protected by the copyright law 1994. The purchaser(s) is purchasing the right to use a design, but that design remains the property of Ondesign Limited. The purchased website will contain two copyright references. The first will read “Content Copyright purchaser's name” and means the textual content of the website is the property of the purchaser(s). The second will read “Graphic Copyright Ondesign” and means the graphic design remains the property of Ondesign Limited. The word “Ondesign” in the copyright reference will contain a link that will direct viewers to the Ondesign website. This link must remain a part of the website at all times. All transactions are final. When a design has been selected and payment has been received, no refunds will be given for a 'change of mind' or preference for another design. If any errors or omissions are found within the purchased website, relating to the graphic design and function of the website, Ondesign will endeavour to amend such errors without charge, but accepts no liability resulting from such errors or omissions. Any errors that result from the information supplied by the purchaser(s) are the responsibility of the purchaser(s). In such circumstances Ondesign is under no obligation to amend such errors. Ondesign will however, usually endeavour to amend such errors, but reserves the right to charge an administration fee if Ondesign deems it to be appropriate. The number of sub-pages included in each purchase option is limited to seven. Further sub-pages can be obtained for an additional charge. All websites are provided as HTML files. For purchase options 1-3, it is the responsibility of the purchaser(s) to ensure their web-hosting company has the capabilities, functions, and size to host a Ondesign website. For purchase options 1-3, it is the responsibility of the purchaser(s) to liaise with their web-hosting company and obtain any necessary instructions and information needed for the uploading of their purchased website. For purchase option 4, Ondesign endeavours to obtain web-hosting only from companies that state an uptime of 99.9% or higher. Ondesign reserves the right to obtain web-hosting from any such company, as it sees fit. For purchase option 4, Ondesign will obtain 500Mb of disk space for hosting of the purchaser(s) purchased website and email accounts. The number of email accounts is unlimited within the stated disk space. Further disk space can be purchased for an additional charge. Ondesign has no liability from any lack of performance, unavailability, or failure of any services provided by a selected web-hosting company. ----------------------------------------------------------------------------------------- Graphic Design Terms and Conditions: All graphic designs remain the intention and property of Ondesign Limited and are protected by the copyright law 1994. The purchaser(s) is purchasing the right to use a design, but that design remains the property of Ondesign Limited. All transactions are final. When a design has been selected and payment has been received, no refunds will be given for a 'change of mind' or preference for another design. All graphic design items to be printed will be uploaded to the Ondesign server and the purchaser(s) will be sent a URL address to view and confirm the item to be purchased is without error and omission. It is the sole responsibility of the purchaser(s) to check and determine any errors and omissions. If any errors or omissions are found within the item to be printed, Ondesign will amend such errors before printing. The item will be printed only upon written confirmation from the purchaser(s) that the item(s) is free from error and omissions. Once confirmation is received by the purchaser(s) to proceed with printing, the liability for any errors or omissions are the sole responsibility of the purchaser(s). Small variations in colour can on occasions be apparent between that which is displayed on a monitor and that which is actually printed. Ondesign will use reasonable endeavours, but does not provide any guarantee that printed graphic items will exactly match the colours displayed on this website. ----------------------------------------------------------------------------------------- Architecture Terms and Conditions: All designs remain the intention and property of Ondesign Limited and are protected by the copyright law 1994. The purchaser(s) is purchasing the right to use a design on a specific site, but that design remains the property of Ondesign Limited. Information provided for use in obtaining building consents, will be specifically intended for the requirements of the purchaser(s) for that purpose only. No warranty is given, intended or implied for use by any third party and no responsibility is undertaken to any third party for any material contained within. The purchase of any architectural item from Ondesign Limited, entitles the purchaser(s) to the use of that item (including design, drawings, information) for one site only. Any further use without prior written approval may render the offender liable for damages. Ondesign has no liability for any lack of performance, unavailability, or failure of the services undertaken by any other parties including but not restricted to, local and regional Territorial Authorities, and other consultants. Documents provided for the obtaining of building consent, have for the most part been used successfully on previous occasion(s). Ondesign will use reasonable endeavours, but does not provide any guarantee that material will be acceptable or that material is sufficient for building consent. If any errors or omissions occur within the documents purchased, Ondesign will endeavour to amend the documents without charge, but accepts no liability resulting from such errors or omissions. Documents provided for the obtaining of building consent, relate to the field of architecture for the chosen design. In most circumstances this information will be enough to obtain building consent. In some circumstances further information outside of the field of architecture may be required, and this shall always be the responsibility of the purchaser(s). Such specialist information may include but is not limited to, geotechnical engineering, fire safety engineering, civil engineering, hydraulic engineering, septic and drainage engineering, structural engineering, surveying. While Ondesign may be engaged in the management of obtaining such information, any fees and costs associated will be the responsibility of the purchaser(s). Lodging the building consent for option 4, is only available in the greater Auckland area, or outside this area if the Territorial Authority will accept lodgement by post. No refunds will be given for purchase option 1. Refunds for purchase options 2-5 will only be given in the event where it is not physically possible to use a chosen design on the site it is intended to be used upon. Ondesign reserves the right to charge a processing fee of $75 in such circumstances.
